By accessing or using the Built By The Trades™ platform, website, and services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

We reserve the right to modify these terms at any time. Your continued use of the Services following any changes constitutes your acceptance of the revised terms.

You must be at least 18 years of age to use our Services, including our SMS messaging program. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms. If you are under 18, you may not use our Services.

Built By The Trades™ provides a cloud-based operations platform designed for trade businesses including but not limited to electrical, plumbing, HVAC, general contracting, mechanical, carpentry, painting, and fire protection companies.

Our Services may include project management, estimating, job costing, crew management, client communications, and other business operations tools. Features and availability may vary and are subject to change.

Built By The Trades™ (operated by Profit Wizard LLC) offers an SMS/text messaging program as part of our Services. By opting in to receive text messages from us, you agree to the following terms:

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree not to use our Services to: violate any applicable law or regulation; infringe on the intellectual property rights of others; transmit any harmful, threatening, abusive, or otherwise objectionable material; attempt to gain unauthorized access to our systems or other users’ accounts; interfere with or disrupt the integrity or performance of the Services; or collect or harvest any information from the Services without our consent.

Certain features of the Services may require payment. You agree to pay all fees associated with your use of the Services in accordance with the pricing and payment terms presented to you.

All fees are non-refundable except as expressly set forth in these terms or as required by applicable law. We reserve the right to change our pricing at any time, with notice to existing subscribers.

The Services, including all content, features, and functionality, are owned by Built By The Trades™ and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our intellectual property without our express written permission.

You retain ownership of any data you submit through the Services. By submitting data, you grant us a limited license to use, process, and store it as necessary to provide the Services.

To the maximum extent permitted by law, Built By The Trades™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Our total liability for any claim arising out of or relating to these terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Built By The Trades™ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your access to or use of the Services or your violation of these terms.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Services will cease immediately.

You may terminate your account at any time by contacting us. All provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Your use of our Services is also governed by our Privacy Policy, available at traderated.com/privacy. The Privacy Policy describes how we collect, use, and protect your personal information, including information collected through our SMS messaging program. By using our Services, you consent to the practices described in our Privacy Policy. If you are a California resident, you have rights under the CCPA/CPRA — including the right to opt out of the sale or sharing of personal information — described in the Your Privacy Choices section of our Privacy Policy, also reachable via the “Do Not Sell or Share My Personal Information” link in the footer of every page.

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located within our principal place of business.
